Agreement to Terms

By accessing or using ThinkFeel.Live ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is provided by Curiositech LLC ("we," "us," or "our"), a California limited liability company.

Service Description

ThinkFeel.Live is a mobile application designed to support emotional awareness through:

• Interoceptive body scanning practices
• Heart rate variability monitoring and biofeedback
• Emotion vocabulary development
• Journaling and reflection tools

The Service is not a medical device, therapeutic intervention, or substitute for professional healthcare. It is a self-directed training tool intended for general wellness purposes.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years of age.

Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

Subscriptions and Payment

Free Tier

Certain features are available without payment. We may modify the scope of free features at any time.

Paid Subscriptions

Paid subscriptions provide access to additional features. Subscriptions are billed in advance on a recurring basis.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

ThinkFeel.Live is not a medical device and does not provide medical advice, diagnosis, or treatment.

The Service is designed for general wellness and educational purposes only. It is not intended to diagnose, treat, cure, or prevent any medical condition or mental health disorder.

If you are experiencing a mental health crisis, please contact a healthcare professional or emergency services immediately. In the United States, you can reach the National Suicide Prevention Lifeline at 988.

User Content

You retain ownership of content you create within the Service, including journal entries, voice recordings, and custom emotion labels ("User Content").

By using the Service, you grant us a limited license to process, store, and synchronize your User Content solely for the purpose of providing the Service to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURIOSITECH LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Dispute Resolution

Before filing any formal dispute, you agree to contact us at legal@thinkfeel.live and attempt to resolve the dispute informally for at least 30 days.

Any dispute arising from these Terms shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in Portland, Oregon.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
